In the event of any discrepancy between versions, the Spanish version shall prevail.

These General Terms and Conditions govern the placing of orders through www.sumehrb.com in accordance with Spanish Law 34/2002 (LSSI-CE) and Royal Legislative Decree 1/2007 (LGDCU — General Law for the Defence of Consumers and Users).

1. Purpose

These Terms govern the distance purchase of food products prepared by SUME Hand Roll Bar through www.sumehrb.com, with in-store pickup and home delivery services.

2. Order Process and Contract Formation

The purchase process involves the following steps:

  • Selecting products from the available menu
  • Choosing the service type: in-store pickup or home delivery
  • Providing the required details: name, phone number, email address and, for delivery, full delivery address
  • Reviewing the order summary and total amount including taxes
  • Confirming the order via the "Confirm and Pay" button, which creates a payment obligation under Article 98.2 of the LGDCU
  • Completing payment by bank card through Stripe

The contract is deemed concluded upon the customer receiving the order confirmation email, which constitutes the receipt acknowledgement required by Article 28 of the LSSI-CE.

3. Prices and Taxes

All prices shown on the Website are in euros and include VAT at the applicable rate. Delivery charges, where applicable, are shown separately before order confirmation. No additional costs will be charged to the customer without prior notice.

4. Payment

Payment is processed securely through Stripe Payments Europe, Limited, a payment institution licensed in Ireland with PCI DSS Level 1 certification. FALCO LIVING, S.L. does not store or have access to the customer's card details at any time.

5. Home Delivery Service

Home delivery is available in the zones indicated on the Website. The minimum order value for this service is €30.00. Estimated delivery times are indicated before order confirmation and may vary depending on demand.

6. Right of Withdrawal

Mandatory consumer information (Art. 103.d LGDCU)

Pursuant to Article 103(d) of Royal Legislative Decree 1/2007, the right of withdrawal does not apply to contracts for the supply of goods liable to deteriorate or expire rapidly. Food products prepared by SUME Hand Roll Bar are perishable items made to order. Therefore, once an order has been confirmed and payment processed, the right of withdrawal cannot be exercised.

7. Cancellations

Due to the perishable nature of the products and their immediate preparation upon order confirmation, cancellations or modifications are not accepted once payment has been made. If SUME Hand Roll Bar is unable to fulfil an order, the customer will be contacted immediately and a full refund will be issued within 14 calendar days.

8. Product Conformity and Complaints

If the order received does not match what was requested, the customer should notify us as soon as possible at info@sumehrb.com. In accordance with Articles 115 et seq. of the LGDCU, the customer shall be entitled to re-delivery of the correct item, a proportional price reduction, or a full refund. These rights cannot be restricted by any contractual clause.

9. Allergen Information

Allergen information for each product is available on the Website menu in accordance with EU Regulation No. 1169/2011 and Royal Decree 126/2015. Products are prepared in a kitchen where all 14 declarable allergens are handled. Customers with severe allergies or food intolerances should contact us before ordering at info@sumehrb.com.

10. Consumer Complaints

Customers may request an official complaint form from the establishment. For online complaints, customers may contact the Junta de Andalucía consumer service at www.juntadeandalucia.es/organismos/haciendayfinanciacion/consumidores. For out-of-court dispute resolution, customers may refer to the Consumer Arbitration System (Sistema Arbitral de Consumo), which is voluntary and free of charge for consumers.

11. Applicable Law and Jurisdiction

These Terms are governed by Spanish law. For contracts concluded with consumers, any dispute shall be resolved by the courts of the consumer's place of residence, in accordance with consumer protection legislation.
